Transgender TET Qualifier denied interview; Calcutta High Court directs 1% reservation for Transgender Persons in Public Employment

Calcutta High Court: A petition was filed by a transgender individual who had successfully cleared the Teachers’ Eligibility Test (TET) in both 2014 and 2022 but was not called for counseling or interview due to discriminatory exclusion from the selection process despite meeting the eligibility criteria. Rajasekhar Mantha, J., directed the West Bengal government to ensure one per cent reservation for transgender persons in all public employment noting the policy of equal treatment in employment for transgenders adopted by the State, emphasizing the need for reservation in accordance with the Supreme Court’s 2014 ruling.

Thus, the Court underscored the importance of implementing the Supreme Court’s directives to treat transgender individuals as socially and educationally backward citizens. Despite the West Bengal government’s policy of equal opportunity for employment without discrimination, the court noted that reservation for transgender persons had not been enforced.
