Supreme Court issues notice in Armed forces veteran’s plea seeking relaxation in Physical Efficiency Test for the post of Forest Guard

Supreme Court: In a special leave petition filed against the Judgment and order passed by the Rajasthan High Court concerning the relaxation in the Physical Efficiency Test for the ex-servicemen of the Armed forces for the post of Forest Guard, the division bench of Sanjay Karol and Aravind Kumar, JJ. has issued notice.

The petitioners argued that despite 12.5% reservation for ex-serviceman and relaxation in age, the State stubbornly refuse to relax qualifying criteria for Physical Efficiency Test, thus forcing older veterans to compete with young. Thus, this is in violation of Articles and of the .

The Rajasthan High Court observed that the relaxation provided for the Ex-servicemen in the Rajasthan Police Subordinate Service Rules, 1989 is not applicable in the present case. The High Court also said that physical fitness is a vital aspect for the post of Forest Guard requiring the selected candidates to endure tough conditions such as mountain climbing and treading through rough terrains, thus the job profile is such that demands physical movement and involves strenuous work, making it crucial that the persons so selected for the post in question maintain a certain standard of physical fitness.

The Court issued notice and directed that steps to be taken as per the Rajasthan Forest Subordinate Service Rules, 2015

The matter will next be taken up on 19-07-2024.
