Supreme Court Collegium recommends extension of term for 9 Additional Judges of Calcutta High Court

On 24-07-2024, the Supreme Court Collegium comprising of Dr Justice D.Y. Chandrachud, Chief Justice of India, Justice Sanjiv Khanna and Justice B.R. Gavai recommended the extension of term for 9 Judges of Calcutta High Court for a fresh term of one year with effect from 31-8-2024.

The Judges are as follows-


  1. Justice Biswaroop Chowdhury,


  2. Justice Partha Sarathi Sen,


  3. Justice Prasenjit Biswas,


  4. Justice Uday Kumar,


  5. Justice Ajay Kumar Gupta,


  6. Justice Supratim Bhattacharya,


  7. Justice Partha Sarathi Chatterjee,


  8. Justice Apurba Sinha Ray,


  9. Justice Md. Shabbar Rashidi,

The afore-stated Judges’ names were recommended by the Collegium of Calcutta High Court unanimously for appointment as Permanent Judges on 29-4-2024. However, the Chief Minister and the Governor of the State of West Bengal did not convey their views on the recommendation.

The Department of Justice thus forwarded the above recommendation by invoking Para 14 of the Memorandum of Procedure which provides that if the comments of the Constitutional authorities in the State are not received within the prescribed time-frame, it should be presumed by the Minister of Law and Justice that the Governor and the Chief Minister have nothing to add to the proposal and proceed accordingly.

To consider the High Court Collegium’s recommendation, the Supreme Court Collegium consulted the Judges who are conversant with the affairs of the High Court at Calcutta. Furthermore, the Chief Justice of India constituted a Committee of two Judges of the Supreme Court who assessed the judgments of the above Additional Judges.

Having evaluated the afore-stated Judges’ merit and suitability, the Supreme Court Collegium thus recommended that their tenure be extended for a fresh term of 1 year.
