A Public Interest Litigation (PIL) has been filed in the Delhi High Court seeking a direction to the Law Commission of India for making an report on the Uniform Judicial Code,to make legal terms, abbreviations, case registration
The petition was filed by Ashwini Kumar Upadhyay who said there exists a huge differences while comparing judicial terms, abbreviations, norms, phrases, court fees and case registration processes used in the Delhi High Court and that of the Allahabad High Court.
The plea cites different terms used by benches of the Bombay High Court and the Rajasthan High Court, which causes lot of confusion.
The petitioner who is also a well known lawyer also points out the differences in court fees sought for similar matters and of similar valuation in different states, which causes injury to citizens.
The PIL prays to direct the Law Commission of India for preparing comprehensive report on Uniform Judicial Code in consultation with the High Courts in order to make uniform judicial terms, abbreviations, norms, phrases, court fee structure and case registration process.
The plea also directs the Law Ministry to take appropriate steps to prepare a comprehensive report on Uniform Judicial Code in consultation with the High Courts;
It requests for constituting an expert Committee to prepare a comprehensive report on Uniform Judicial Code in consultation with the High Courts.
A similar sort of plea was withdrawn by the petitioner before the Supreme Court last year and has now filed the same before the Delhi High Court.
