The Supreme Court refused to entertain a petition filed by former Indian skipper Mohammad Azharuddin against the contempt notice issued to him by the Telangana High Court over a dispute between the Hyderabad Cricket Association (HCA) and the Nalgonda District Cricket Association (NDCA).
The Bench of Justice B.R. Gavai and Justice Prashant Kumar Mishra, while dismissing the plea as withdrawn, granted liberty to the former HCA President to file it’s response before the High Court.
The Apex Court noted that since the High Court had only issued a contempt notice, it would be appropriate for the petitioner to approach the Telangana High Court.
The counsel again urged the top court of the country to take up the matter.
The Bench asked the lawyer whether his client has been held guilty of contempt. The counsel replied in negative.
The Apex Court then told him to approach the High Court.
The Advocate apprised the Bench that a writ petition was pending before a Coordinate Bench of the Telangana High Court and prayed for them to be heard together.
However, the Apex Court directed him to seek relief from the High Court.
The Supreme Court recorded in its order that the petition has been dismissed as withdrawn.
It directed the Chief Justice of the Telangana High Court to consider the consolidation of contempt petition with writ petition in accordance with law.
