The Delhi High Court has directed Telugu actor Manoj Manchu, certain media houses and X (formerly Twitter), to take down within one week, all articles, videos and posts defaming media professional Vinay Maheshwari.
The single-judge Bench of Justice Swarana Kanta Sharma granted ex-parte interim injunction in favour of Maheshwari on the grounds that Manchu’s tweets prima facie appeared to be defamatory.
It noted that the statements and messages, made without any substantiation, were prima facie defamatory, since they alleged unethical and illegal behaviour, harming the plaintiff’s professional reputation and personal standing.
The High Court further observed that the allegations of malicious intent and interference in family matters portrayed the Plaintiff in a negative light, leading to a significant loss of goodwill and public trust.
It also restrained Manchu from further posting any defamatory post or article on any messenger service, social media or any public platform regarding Maheshwari and his family.
Media platforms GreatAndhra, ABP Network, Onmanorama, IndiaGlitz and TeluguOne were also directed to take down the allegedly defamatory articles from all platforms, social media and websites.
The single-judge Bench further ordered the media platforms to ensure that the same were not accessible through any archives or databases.
The High Court also directed Twitter to ensure the removal of Manchu’s tweets.
It also took into account an undertaking submitted with regards to the reports published by Hindustan Times, which saud that the newspaper would contact Maheshwari and publish his version or clarification.
