Bombay High Court disposes of PIL seeking declaration of Thalassemia as benchmark disability

The Bombay High Court disposed of a Public Interest Litigation (PIL) seeking to espouse the cause of those who are suffering from Thalassemia as a benchmark disabilities.

The petition is filed by a businessman.

The Division Bench of Acting Chief Justice Nitin Jamdar and Justice Sandeep V. Marne noted that the petitioner is neither an expert in this field nor the petition is filed by any organisation dealing with the persons with this disabilities.

“Nothing is demonstrated before us that this particular class of persons who are suffering from this disability cannot approach the Court in respect of redressal of the grievances faced by them”, the Court held.

As and when this cause is appropriately represented as above, the issue would be examined , the Court said.
