Allahabad High Court directs UP Service Commission to present answer sheets to candidate appearing in PCS-J Main exam 2022

The Allahabad High Court has directed the UP Service Commission to present the answer sheets of six question papers of candidate Shravan Pandey who appeared in PCS-J Main Examination 2022 before the court.

The Division Bench of Justice Siddhartha Varma and Justice Manish Kumar Nigam passed this order while hearing a petition filed by Shravan Pandey.

Counsel for the petitioner submitted that the petitioner appeared in the U.P Judicial Service Civil Judge (Junior Division) (Mains) Examination 2022 in the month of May, 2023. The result was declared on 30.08.2023. Thereafter, the marks were put in the public realm in November, 2023.

Aggrieved by the marks which the petitioner had got, he moved an application under the Right to Information Act on 07.01.2024.

On 27.03.2024, the petitioner was provided the distribution of marks in the six papers in which he had appeared. On 27.03.2024, itself the petitioner got information that he had received 47 marks out of 200 marks in the English paper. Not being satisfied with the marks, the petitioner prayed that six papers’ answer sheets be shown to him under the Right to Information Act.

When the answer sheets were shown on 25.05.2024, the petitioner found that the hand writing of the petitioner as existed in all the other papers was not to be found in the English answer sheet. He also found that the answers in the answer sheet of the Hindi paper were scored off in the last 3-4 pages.

Confronted by the situation, the Court has decided that all the six answer sheets of all the six papers which the petitioner had written be produced before the Court. This would enable us to meet see whether the handwriting in the English answer sheet was in his hand writing.

If all the answer sheets are produced, the court shall be able to compare the hand writing of the petitioner in the answer sheet of the English paper with the answers written in all other answer sheet.

Counsel stated that the other papers (other than Hindi) were written in English.

The Court has fixed the next hearing of the petition on 07.06.2024.

On that date, all the answer sheets of six papers be produced before the Court, the Court ordered.
