The Centre for Maritime, Admiralty, and Navigation Laws (C-MAN) is committed to advancing research and excellence in maritime law and related fields.
About the Competition
This inaugural competition aims to encourage students and scholars to delve into contemporary maritime legal issues. Participants are invited to submit original blog entries that present fresh insights, critical analysis, and innovative perspectives on legal challenges in the shipping industry.
Theme
“Interplay between the Admiralty Act, 2017 and the Arbitration and Conciliation Act, 1996”
The Admiralty (Jurisdiction and Settlement of Maritime Claims) Act, 2017 empowers a Court to make an order of arrest in relation to a maritime claim against a vessel, which is an in-rem action, subject to the conditions stipulated under the Act. This is an Act specifically enumerated for admiralty disputes. Therefore, the interesting interplay between the provisions therein and the generic reliefs as available in the Arbitration & Conciliation Act, 1996 is to be concretely explored for resolution of disputes between the parties.
