Supreme Court rejects plea seeking ban on politicians from holding posts in lawyer bodies

The Supreme Court on Friday dismissed a petition seeking direction to prevent members of political parties from holding posts in the Bar Associations and Bar Councils across the country.

The Bench of Justice Surya Kant and Justice Ujjal Bhuyan orally remarked that there was nothing wrong with politically affiliated persons holding positions in the bar bodies.

Taking names of Supreme Court Bar Association President Kapil Sibal (also a Congress leader) and Bar Council of India Chairman Manan Kumar Mishra (also a BJP leader), the Apex Court asked whether the petitioner wanted to oust them?

The petitioner contended that the independence of bar bodies would be compromised if persons with political ideologies became their elected leaders.

The Bench then cited the example of Ram Jethmalani, who served as the BCI Chairman and the SCBA President, while remaining active in politics.

It further asked whether the petitioner wanted the bar to be deprived of the services of such multi-talented persons.

The Apex Court, however, gave liberty to the petitioner to pursue representations.
