Supreme Court: The 3-Judge Bench of Dr DY Chandrachud, CJ, J.B Pardiwala and Manoj Misra, JJ., took note of the 5th Status Report filed by the CBI wherein it was stated that a chargesheet has been submitted against the primary accused on 7-10-2024 for alleged offences punishable under Sections , , of the (BNS) and that the ACJM, Sealdah, Kolkata has taken cognizance and committed the case to the Court of the Additional Sessions Judge, 1st Court, Sealdah.

The Court directed that CBI must apprise the Court vis-a-vis status of the investigation in the matter via Status Report within 3 weeks.

The Court took note of the in pursuance of its orders dated 20-8-2024 and the subsequent meetings that have been conducted by the NTF so far. The Court observed that neither the National Task Force nor the Sub-Groups have made any substantial progress in pursuant of the remit set in the order of the Court and that no meeting has been held since the first week of September 2024.

Hence the Court opined the Union Government must make pro-active efforts to ensure that the work of the Task Force is completed within a reasonable period in the future. Accordingly, the meetings of the NTF shall be held at regular intervals. All Sub-Groups shall hold regular meetings so that by the next date of listing, the Court is apprised of the tentative recommendations of the NTF including its Sub-Groups. This exercise should preferably be completed within a period of three weeks.

Coming onto the affidavits submitted by the Department of Family Welfare, Government of West Bengal indicating the status of State Government sanctioned work worth Rs 123 crores in several medical colleges and at RG Kar Medical College, the Court took note of the assurances provided the State’s counsel that short fall in the work in the 28 medical colleges would in any event be completed by 25-10-2024 and at the RG Kar Medical College and Hospital by 31-10-2024.

It was further noted that the State Government had constituted a State Level Grievance Redressal Committee; and State and District Level Committee for Security Audit. The State Government has submitted that an initial round of security audit has been completed. An additional 1,514 security personnel have been approved for deployment in the medical colleges and hospitals, of which 910 would be female security personnel. The verification of antecedents and necessary training was stated to have been completed in the case of 616 security personnel (comprising of 328 female and 228 male security personnel).

Furthermore, the Court took note that the affidavit stating the reconstitution of Rogi Kalyan Samiti of different medical colleges and has rolling out of an Integrated Hospital Management System which has 1,013 government hospitals reporting thereon. It has been stated that IHMS envisages capturing every step of patient treatment through online OPD ticket booking, e-prescription, drug dispersal from drug stores and pharmacies and online discharge. The State government is also taking steps on a pilot basis for monitoring real time bed availability and an online centralized referral system. The Court directed that it shall be apprised within three weeks of the further progress which has been made in commissioning these facilities.

The Court directed the State of West Bengal to submit an affidavit explaining the following:

(i) The legal source of authority for the recruitment of Civic Volunteers in the State;

(ii) The modalities for recruitment;

(iii) The qualifications for recruitment;

(iv) The verification of antecedents which is carried out before recruitment is made;

(v) The institutions in which the Civic Volunteers are assigned duties; and

(vi) The payments made to Civic Volunteers, whether on a daily or monthly basis and the budgetary outlays in that regard.

The Court specifically issued directions regarding disclosure of the selection process which is followed for the recruitment of the Civic Volunteers and the steps which have been taken to ensure that such Civic Volunteers do not operate in sensitive establishments, such as hospitals and schools, which may be particularly vulnerable to women and children. The affidavit must specifically disclose whether any of the Civic Volunteers are assigned duties in or in connection with police stations or for the investigation of the crime.

The petition has been listed for the next hearing on 5-11-2024.
