The Patna High Court recently dismissed a public interest litigation (PIL) seeking a proper inquiry and directions against officials of the Rajkiya Tibbi College and Hospital, Patna, for allegedly admitting students to the BUMS course based on forged and fabricated marksheets/certificates.

The petitioner submitted that 16 students were wrongly admitted to the college and sought cancellation of their admission.

However, the Division Bench of Chief Justice K Vinod Chandran and Justice Partha Sarthy observed that the representations supporting the averments in the petition were made in 2020, and it was unclear why an inquiry was being sought four years later, especially since none of the affected students were impleaded in the petition.

The court found no reason to entertain the PIL but made it clear that any orders passed in an inquiry with notice to the students against whom allegations were raised would not be affected by the dismissal of the writ petition.

The court ultimately dismissed the PIL, holding that it was not a suitable case for judicial intervention.
