Gauhati High Court dismisses PIL on irregularities in PDS kerosene distribution

The Gauhati High Court has recently dismissed a public interest litigation (PIL) petition filed by Ram Bahadur Sunar, raising concerns about irregularities in the distribution of kerosene and other petroleum products under the Public Distribution System (PDS) in Arunachal Pradesh.

The petitioner alleged that certain individuals, in connivance with government officials, were misappropriating these essential items meant for distribution to the public.

The petitioner claimed that some cases had been registered by the police, but no action had been taken against those involved in other instances.

After hearing the petitioner’s counsel and reviewing the material on record, the Division Bench of Chief Justice Vijay Bishnoi and Justice Kaushik Goswami prima facie found that the petitioner had raised a grave concern about interference with the PDS.

However, the court noted that the petitioner had not filed any complaint with the concerned police station or competent criminal court regarding the alleged criminal activities.

The petitioner’s counsel subsequently requested permission to withdraw the PIL petition, with liberty to approach the concerned police station or competent criminal court to highlight the alleged criminal activities.

The court granted this request, dismissing the PIL petition as withdrawn.
