The Gauhati High Court has closed a Public Interest Litigation (PIL) filed by the petitioners alleging that there are commercial construction establishments in a Higher Secondary School in Dibrugarh.
D. Saikia, Advocate General, Assam has placed on record photocopy of the communication dated 08.04.2023 issued by the Principal of the Higher Secondary School to the Inspector of Schools, Dibrugarh District Circle, conveying that the proposal taken in the meeting of the School Management and Development Committee (SMDC) dated 15.11.2022 for constructing commercial establishments has been changed and withdrawn.
According to the letter, the SMDC has now planned to construct the school buildings in an orderly manner so that the students can be facilitated with a better classroom environment.
The letter also states that the school has already been listed for grant under the “PM Shri School”.
The efforts of the Advocate General, Assam in ensuring that the commercial construction does not take place in the educational institution are appreciated by the Division Bench of Chief Justice Sandeep Mehta and Justice Parthivjyoti Saikia.
In this view of the matter, the Court closed the PIL petition because the cause of action does not survive any longer.
