Andhra Pradesh High Court: In a petition filed by Ram Gopal Varma (‘the petitioner’) seeking anticipatory bail, Harinath N., J., stated that it would be appropriate for the petitioner to cooperate with the investigation and directed that the petitioner should be released on bail in case of arrest. The Court directed the petitioner to furnish a personal bond of Rs.20,000 with two sureties for a like sum, to the satisfaction of the Station House Officer, Maddipadu Police Station. Further, the petitioner should cooperate with the investigation as and when required for the purpose of investigation.
Background
The petitioner was alleged to have committed offenses under Sections , , 366(2), , , of and Section of the . It was alleged that on 10-11-2024, while the complainant was accessing his Twitter account, he came across three postings on the petitioner’s Twitter account, which the complainant found to be defamatory and objectionable.
Subsequently, the complainant filed a complaint before the Station House Officer, alleging that he was the General Secretary of a political party and that the postings were objectionable to the interest of the party to which he belonged. Thus, the police registered a case and began their investigation.
Analysis, Law, and Decision
After perusal of the record and the case diary submitted by the public prosecutor, the Court stated that it was evident from the case diary that the postings made in the petitioner’s Twitter account in the months of December 2023 and May 2024. However, the Court stated that considering the facts and circumstances of the present case, the provision of law related to of would not be applicable. So far as the applicability of other provisions of law and establishment of the crime, the Court stated that police would be required to complete their investigation.
The Court stated that it would be appropriate for the petitioner to cooperate with the investigation and directed that the petitioner should be released on bail in case of arrest.
