Allahabad High Court stays arrest of Kasimabad panchayat chairman

The Allahabad High Court has stayed the arrest of the chairman of Kasimabad Nagar Panchayat, Ghazipur in a case of extortion and threats.

The Division Bench of Justice Siddharth and Justice Subhash Chandra Sharma passed this order while hearing a petition filed by Reyaz Ahmad Ansari and Another.

The petition has been preferred with the prayer to quash the First Information Report dated 29.10.2024 registered as Case under sections 308(5), 352, 351(3) and Section 296 of BNS, Police StationKasimabad, District – Ghazipur, and for a direction to the respondents not to arrest the petitioners in pursuance of impugned First Information Report.

With regard to the allegations made in the FIR there appears to be dispute between parties with regard to management of a Madarsa. The police investigation is still going on. It would not be appropriate for the Court to enter into the factual dispute raised before the Court, the Court said.

“For the reasons given in the order dated 10.07.2024, till the next date of listing or till cognizance is taken by court on police report submitted under Section 193(3) BNSS, whichever is earlier, the respondents are restrained from arresting the petitioners pursuant to the First Information Report, subject to cooperation in ongoing investigation. The Police will conclude the investigation within a period of sixty days,” the Court ordered.
